Convicted Beltway sniper John Allen Muhammad is scheduled to be executed by lethal injection November 10, a Virginia corrections official said Tuesday.

"Inmate John Muhammad was offered a choice in method of execution, and he declined," Larry Traylor said. "Under the code, if the inmate declines to choose, it defaults to lethal injection."

Muhammad was convicted of killing Dean Harold Meyers, one of several victims in a series of sniper-style shootings that terrorized the Washington area in October 2002.

During a three-week period, Muhammad and his young protege, Lee Boyd Malvo, shot 13 people, killing 10 of them, police said. The two also are suspected in other shootings, including in Tacoma, Washington; Montgomery, Alabama; and elsewhere in the Washington metro area.

Attorneys for Muhammad argued last week that he should be given clemency on the grounds that he has a severe mental illness that worsened while he served in the Persian Gulf War.

Attorney Jonathan Sheldon said he and other attorneys presented Virginia Gov. Tim Kaine's representatives with audio interviews with attorneys, mental health experts and witnesses rather than a written document. They said they plan to file an appeal with the U.S. Supreme Court on November 3.

Kaine's office said that any information on the clemency request would come in the form of a news release at a later date.

Honestly I think this guy should be executed by a firing squad,but what do I know.

Lawyers for convicted Beltway sniper John Allen Muhammad have asked the Supreme Court to block next week's scheduled execution.

An appeal was filed Tuesday evening with the justices, but there was no indication when the court would rule. A clemency request has already been filed with Virginia Gov. Timothy Kaine's office.

Muhammad, 48, is scheduled to be executed November 10 for the murder of Dean Harold Meyers at a gas station in Manassas, Virginia. Muhammad recently transferred to death row at Greensville Correctional Center in rural southern Virginia.

Muhammad and teenage accomplice Lee Boyd Malvo terrorized the nation's capital for three weeks in October 2002, responsible for the sniper-style killings of 10 people in Maryland, Virginia, and the District of Columbia, police believe. Three others were wounded by high-powered gunfire, said police.

The pair was also suspected in earlier, similar shootings in Washington state, Louisiana, Alabama, and the Washington, D.C. area.

In their appeal, his attorneys say Muhammad was not given sufficient time to file his appeal. But the bulk of the brief dealt with claims the defendant was mentally unstable and that he received ineffective counsel at trial.

"There is overwhelming objective evidence that would have likely led to a finding that Muhammad was incompetent to stand trial," said the brief filed Tuesday.

"Trial counsel also had first-hand confirmation of the impact of these [mental illness] factors in their own experience of Muhammad's bizarre behavior and delusional beliefs, as well as witnesses they interviewed pre-trial who described Muhammad in terms that indicated severe mental illness."

In a statement last month attorney Jon Sheldon said the alleged brain damage was caused by childhood beatings and "certainly exacerbated by the Gulf War Syndrome he suffered before and after serving as a sergeant in the first Iraq war." The Supreme Court outlawed execution of the mentally retarded in 2002, four months before the sniper assaults.

Muhammad should serve life without parole, Sheldon said. Such a sentence would "keep the people of Virginia safe."

The clemency request was unusual in that it was presented entirely with audio interviews with attorneys, mental health experts and witnesses, rather than a standard written document. Both Sheldon and Kaine's office have refused to release the audio statements to CNN and other media.

There was no word when Kaine would rule on the request. He told a Washington area radio station in late September he was inclined to deny clemency.

"I know of nothing in this case that would suggest that there is any credible claim of innocence or that there was anything procedurally wrong with the prosecution," the governor told Washington radio station WTOP.

Lower federal courts have previously turned down Muhammad's claims that he should not have been allowed to serve as his own attorney for a part of his criminal trial because of his mental illness. He also claimed prosecutors withheld critical evidence. The Supreme Court last year denied Muhammad's first round of appeals.

Muhammad and Malvo were charged with hiding from cover and firing their rifle at random individuals. Victims were shot at various locales -- outside gas stations, a restaurant, a hardware store and the victims' homes.

Police found a laptop on the pair when they were arrested that showed a "blueprint" for the shootings, placing them at locales where the crimes took place. Tarot cards were also left at some scenes, showing the figure of "Death," with one including a handwritten message "Dear Policeman, I am God."

The pair was arrested October 24, 2002, sleeping in their car at a Maryland rest stop.

Malvo eventually testified against his mentor and is serving life in prison.

Chris, Your idea of execution by firing squad fits in well with the Law of Moses. Check out Leviticus 24:19-21.

Not just, "an eye for an eye," but, depending on which translation of the Bible you're reading from, it says basically that by whatever measure of damage one does to another, "so shall it be done unto him."

He shot people, so he should be shot.
Bring on the firing squad.

Now just imagine if all killers who were to be executed had to die the same way as their victims.

Well Chris, I suppose we're on the same page on this issue.

Nothing makes me angrier than when killers and rapists get more sympathy than their victims. Even when a killer is executed, while some protest against it, it is done in the most painless and comfortable manner possible. I can't help thinking that this is not how the victims died.

I was astonished when I read about the protest outside the prison when the Oklahoma City Bomber was executed.

It deeply disturbs me how concerned people are about the "rights" of violent criminals. Perhaps they turn a blind eye to the suffering of the victims and their families.

I can go on and on about this. Perhaps I will start a new topic on it.

The Supreme Court refused Monday to block the execution of John Allen Muhammad, the mastermind of the sniper team that terrified the suburbs of the nation's capital in October 2002.

Known as the D.C. Sniper, Muhammad is scheduled for execution Tuesday evening at a state prison near Jarratt, Virginia.

Muhammad, 48, has continued to profess his innocence during two lengthy trials, including one featuring testimony from young accomplice Lee Boyd Malvo, whom Muhammad referred to as his "son."

With the Supreme Court denying his appeal, Muhammad, 48, is all but sure to die by lethal injection at 9 p.m. ET Tuesday at the Greensville Correctional Center.

The only remaining issue is a clemency petition to Virginia Gov. Tim Kaine, who has indicated that he is not apt to grant it.

Lawyers for Muhammad also could file additional appeals, although it is not clear on what grounds.

Prosecutors say Muhammad, fueled by grudges against the Army and his ex-wife, plotted a cross-country shooting rampage, culminating in a killing spree in Washington.

During three weeks in October 2002, Muhammad and Malvo killed 10 people and wounded three while taunting police with written messages and phoned-in threats and demands. In notes left at shooting scenes, the snipers demanded $10 million to stop the shootings.

Prosecutors say Muhammad intended the killings to provide a smokescreen to cover up his real goal: He hoped to kill his wife, Mildred, and gain custody of his three children.

Defense attorneys and some supporters say Muhammad is mentally ill and suffered post-traumatic stress disorder during his service in the Persian Gulf War.

Muhammad was convicted of capital murder and terrorism charges in Virginia for killing Dean Harold Meyers, a Vietnam veteran cut down by a single bullet as he filled his gas tank at a Manassas, Virginia, service station.

Muhammad also stood trial in Maryland and was convicted of six murders there.

Malvo was tried in Virginia for the October 14, 2002, murder of FBI analyst Linda Franklin, 47, outside a Home Depot in Fairfax County, Virginia. A jury sentenced Malvo to life in prison after defense attorneys said Malvo, who was 17 at the time of the murders, was brainwashed by Muhammad.

Malvo testified against Muhammad at Muhammad's Maryland trial, calling him a "coward."

This was on a local TV news station tonight.
They said Muhammad made a last meal request, but he asked the press not to divulge what his last meal was.
Why is that a secret?

The courtesy granted to convicted, and even soon to be executed felons is certainly interesting, to say the least.

I might have mentioned that Washington, DC is my home town. Having relatives and old friends in the area, it was a great relief to me when he was caught. No one I know was among the victims, but I know for sure there very well could have been.

I will not mourn his passing.
